Amendments in Increase Rates Regarding Rental Agreements!

11 Haziran 2022 tarihli ve 31863 sayılı Resmi Gazete’de yayınlanan Avukatlık Kanunu İle Türk Borçlar Kanununda Değişiklik Yapılmasına Dair Kanun ile yeni mevzuat değişiklikleri yürürlüğe girmiştir.
New legislative amendments came into force through the Law on Amending the Attorney Act and Turkish Code of Obligations published in the Official Gazette dated June 11, 2022, numbered 31863. The following provisional article has been included to the Turkish Code of Obligations numbered 6098 (“TCO”):

1. In terms of residential rents, agreements regarding the increase to rental fee to be applied in renewed rental periods between 11.6.2022 and 1.7.2023 (including this date) are valid, provided that it does not exceed 25% (twenty five percent) of the rental fee of the previous rental year.

2. If the rate of change in 12 (twelve) months moving consumer price index (CPI) averages of the previous rental year is below 25% (twenty five percent), CPI rate of change rate is valid. This rule also applies to rental agreements executed for more than one year. Agreements exceeding these rates are invalid in terms of excessing amount.

3. The article is also applicable in case the rental fee is re-determined pursuant to Article 344/2 of TCO.
